1. GENERAL

1.1  The Patient Central Hub (the Hub) and www.patientcentralhub.com.au (the Website) are the property of  Servier Laboratories (Aust) Pty Ltd (ABN 54 004 838 500) located at Level 4, Building 9, 588A Swan Street, Burnley, Victoria 3121, Australia (Servier). The Hub aims to bring together multi-disciplinary teams of healthcare professionals affiliated with a hospital, healthcare institution or patient association (the Healthcare Institution) to share good quality projects that improve the care and quality of life of patients with cancer across Australia.

1.2  The Patient Central Award (the Award) is a financial sponsorship provided by Servier to a project submitted to the Hub as determined by the judging process outlined below.

1.3  The Award will only be granted to a Healthcare Institution, to which the multidisciplinary team of healthcare professionals or patients/carers is linked and not to an individual person.

 

2. THE PROJECT

2.1 The Award will be granted to a project (as determined by the judging method outlined below) that contributes to improving the care and quality of life of patients with cancer (the Project).

2.2 To be considered for the Award, a Project must :

  1. be an existing project

  2. improve the care and quality of life of patients with cancer;

  3. be usable in, or be transferable to other healthcare institutions;

  4. have a demonstrable positive improvement on the care and quality of life for patients living with cancer; 

  5. be submitted by a multidisciplinary team of healthcare professionals or patients/carers affiliated with a Healthcare Institution.

3. CONDITIONS FOR PARTICIPATION

3.1 A Project proposal must be submitted:

  1. digitally by completing the Entry Form on the Website on or before July 31, 2022;

  2. by a multidisciplinary team of healthcare professionals (such as medical specialists, oncology nurses or hospital pharmacists, etc) or patients/carers affiliated with a Healthcare Institution;

  3. with the express permission of authorised representatives of the Healthcare Institution, being aware of the Project submission and its contents, accepting these Terms and Conditions (including that personal information submitted in the Project proposal will be handled, used and stored by Servier in accordance with its Privacy Policy);

  4. with the Project team members and the Healthcare Institution agreeing to Servier producing a short film impression of each Project (which may include photographs or video footage of Project team members) (Film) and publishing it on the Website;

  5. with the relevant Healthcare Institution receiving the Award agreeing to enter into a written sponsorship agreement with Servier in accordance with the Medicine Australia Code of Conduct and as per the Terms and Conditions of the Hub prior to the presentation of the Award, and agreeing that a representative of the Healthcare Institution will attend the presentation of the Award. 3.2  By submitting a Project, the Healthcare Institution:

  1. permits Servier to display the name and logo of the Healthcare Institution on the Website and in Servier publications and communications (digital, paper or otherwise);

  2. warrants that Servier’s and other Healthcare Institutions use of any intellectual property rights in the proposed Project (“Project IP”) will not infringe the intellectual property rights of any third party and the Healthcare Institution owns or is authorised to licence to Servier and other Healthcare Institutions its IP insofar it is licensed in these terms and conditions;

  3. indemnifies and holds Servier and other Healthcare Institutions against and from any loss, damage, costs, expenses, claims, proceedings or investigations arising out of or in connection with any claims from third parties in connection with the Project including the Project IP; and

  4. grants to Servier and other Healthcare Institutions a perpetual, irrevocable, transferable, sub-licensable, worldwide and royalty-free licence to use, modify, reproduce, communicate, distribute, adapt, publish or otherwise deal with the Project IP (including the Film).


3.3 All Servier employees or persons (legally) affiliated with Servier and their family members are excluded from participating in the  Hub, including developing or submitting proposed Projects and in the public voting of the shortlisted Projects.

 

 4. PARTICIPATION

4.1 Only Projects submitted within the period stipulated on the Website will be considered for the Award. The Project submitter will receive an email confirmation of receipt of the Project within one week of submission.

 4.2 Only Project entries that are completed correctly and meet the conditions of clauses 1, 2 and 3 of these Terms and Conditions, will be considered for the Award.  Servier may ask for more information regarding a Project entry, which should be provided to Servier as soon as possible, but preferably within 5 working days.

 4.3 The Project entry must specify the use of the Award, which must be either used for the Project, or on a new project if stated in submission, including the financial estimate at the time of the entry.

 4.4 Servier and its authorised representatives are not responsible or liable for lost, delayed, incorrectly addressed, incorrectly delivered, damaged or undelivered Project entries, or for Project entries that are otherwise not uploaded before the published entry deadline.

 

 5. ASSESSMENT and VOTING

5.1 Projects will be published on the Website together with a short film impression of each Project (prepared by Servier). Once the projects, with the short film impressions are available, members of the public will cast vote by means of a voting button on the Website during the voting period.

5.2 Four projects that gain the highest amount of public votes will be shortlisted for assessment by an expert and independent multidisciplinary panel (assembled by Servier).

5.3 The panel will be composed of persons representing the following disciplines:

  • 1 medical oncologist;

  • 1 haematologist;

  • 1 oncology nurse practitioner;

  • 1 oncology pharmacist; and

  • 1 patient or carer representative (together, the Panel).

 5.4 Panel members are excluded from developing or submitting proposed Projects.

 5.5 If the Panel requires more information regarding a Project entry to determine whether it meets the requirements, the Panel reserves the right to contact (by telephone or email) the Project submitter for further explanation or information.

5.6 The Award will be presented to the shortlisted Project that gets the highest total score, which is the sum of: A) the score awarded by the Panel; and B) the number of votes (one vote=one point) cast via the Website. Based on the Panel’s ranking of the shortlisted Projects, the following Panel score will be awarded:

  • ranked 1st: 100 points;

  • ranked 2nd: 75 points;

  • ranked 3rd: 50 points; and

  • ranked 4th: 25 points.

 5.7 The Panel score will be added to the public votes for each shortlisted Project. The shortlisted Project with the highest number of points will receive the Award. In the event of a tie, the Panel will decide which project receives the Award. In such a situation, the Panel may distribute the Award across multiple Projects as described in clause 6.2.  The Award recipient is determined by Panel and public voting.  Servier has no influence on public voting or in the Panel’s casting vote.

5.8 Once voting ends and the scores tallied, and, if required, the Panel has made a final declaration, the Panel will notify Servier and the Award recipient, and Servier will publish the results and the date and location of the Award-giving ceremony on the Website .

6. THE AWARD

6.1 The Award is a payment of AUD 15,000.00 (fifteen thousand Australia Dollar) excluding GST, payable by Servier to the Award recipient as a financial sponsorship of its Project.

6.2 In the event the Panel declares multiple Award recipients, the Panel will recommend to Servier that it equally distribute the Award across these Project entries.

6.3 The Award amount will only be paid to the Healthcare Institution upon execution of a sponsorship agreement and Servier’s receipt of a Valid Tax Invoice from the Healthcare Institution.  Following receipt of the Award amount and its use towards the Project, the Healthcare Institution must provide Servier a detailed account of how the award will be spent within 3 (three) months.

6.4 The Award must be fully spent within 12 months of receiving the Award, as specified in the item 4.3. Any unspent amount must be refunded to Servier upon request.

6.5 In the event of the awarded Healthcare Institution’s refusal or non-acceptance of the Award or the conditions attached to the Award, the Award will not be granted to that Project and the Panel may or may not designate another Project to receive the Award.

 

7. PRIVACY

7.1 Servier Laboratories (Aust.) Pty Ltd is bound by the Privacy Act 1988 (Cth). 

 7.2 We collect and use your personal (including sensitive) information necessary to carry out our business including for the purposes of sales and marketing, providing starter packs, information and promotional material about our products and services or those of third parties which may be of interest to you, planning educational events and performing any other functions and activities relating to our business (refer to our Privacy Policy for full details).

7.3 If you do not wish to provide us with your personal information, you may not be able to access the Hub or be eligible for the Award and we may not be able to accept your Project entry.

7.4 Your personal information may be disclosed to third parties such as data verification providers (who may disclose your personal information to their clients), mailing houses, conference organisers, or to our related entities including Servier Head Office in France.

8. REGISTER

Entrants and Award recipients expressly agree to the inclusion of their Project entry in a register accessible to everyone. The aim of this register is to make knowledge and experience of healthcare professionals, as well as best practices, available as inspiration for other healthcare professionals looking for ways to improve patient care in cancer. In this way, the entrants and the Award recipients also give their express permission that everyone can use the information about the Project in the Healthcare Institution to which the healthcare professional is affiliated.

 

9. OTHER

9.1 Neither entrants nor Healthcare Institutions can derive rights from and/or receive compensation for participation in the Hub other than as explicitly described in these Terms and Conditions.

9.2 Servier reserves the right to disqualify or remove a submitted Project if the entrant or Healthcare Institution does not comply with these Terms and Conditions or otherwise improperly access or participate in the Hub. 

9.3 Printing, spelling or other similar errors cannot be invoked as grounds for additional obligations for Servier.

9.4 In all cases not provided for in these Terms and Conditions, the management of Servier will decide after consultation with the Panel members.

9.5 Servier may, at its complete discretion, amend these Terms and Conditions during the operation of the Hub, or discontinue, change or amend the Hub or the Award, without explanation or being obliged in any way to Project submitters or Healthcare Institutions. Servier will notify any amendments made to these Terms and Conditions or discontinuance of the Award or the Hub via the Website.
